Role of the Vice President:-

Indian vice presidents are appointed in a similar way to US vice presidents. Vice-President is the second-highest position in India after the Prime Minister. The position and the role of Vice-President are mentioned in Article 63 of the Indian Constitution. In addition, the vice president serves as the Rajya Sabha’s official chairman.


What is the Indian system for electing the vice president?

  1. The Vice-President is chosen by an electoral college made up of representatives from both Houses of Parliament using a single transferable vote under the proportional representation system.
  2. Voting in this election is conducted in secret.
  3. All members of both Houses of Parliament make up the Electoral College, which chooses the Vice-President.
  4. The Vice-President does not belong to the House of any state’s Legislature or to either House of Parliament.
  5. When a member of either the House of Representatives or the House of the Legislature of any state is elected vice president, that member is assumed to have given up their position in the lower chamber on the day they take the office.
  6. Before the term’s expiration, a vote is held to fill the vacancy left by the vice president term expires.
  7. If a vacancy occurs due to a death, resignation, removal, or other circumstance, an election is held as soon as feasible to fill the position.
  8. The person who is thus chosen is qualified to serve a complete term of five years beginning on the day he takes office.


Eligibility Criteria:-

  1. He or She must be an Indian citizen.
  2. The minimum age limit is 35 years.
  3. Must be eligible to be a member of the Rajya Sabha.
  4. Not holding any lucrative position.

Facility:-

  1. As the Rajya Sabha’s ex officio chairman, the vice president is currently paid a salary of Rs. 400,000 a month.
  2. The vice president is also entitled to a daily allowance, a free furnished house, as well as medical, travel, and other privileges.
  3. According to the constitution, the vice president is allowed to receive the same compensation and perks as the president when performing the president’s functions.
  4. For the vice president, the pension is equal to 50% of their pay.


Vacancy:-

  1. As soon as his five-year tenure is up.
  2. In his resignation.
  3. When he is eliminated.
  4. After his death.
  5. Once his election has been ruled invalid.


Power of the Vice President:-

  1. He serves as the Rajya Sabha’s ex-officio chairman. His authority and responsibilities in this role are comparable to those of the Speaker of the Lok Sabha.
  2. When the President’s position becomes vacant owing to his resignation, removal, death, or some other reason, he fills the vacancy. He can only serve as President for a maximum of six months until a new President must be chosen.
  3. It is not possible to contest a vice president’s election on the grounds that the electoral college was insufficient.
  4. Actions carried out by a person prior to the date on which the Supreme Court issues its declaration that a person’s election as Vice President is void is not nullified.


Impeachment:-

  1. The Vice President’s terms of office and the process for removing him or her from office by the Parliament are covered in Article 67 of the Constitution.
  2. A decision of the Council of States adopted by a majority of all the Council’s members at the time may remove a Vice President from office (Rajya Sabha).
  3. The Lok Sabha (House of the People) must approve this resolution to impeach the vice president.
  4. A Vice-President shall continue to hold office despite the end of his term until his replacement enters the office.
  5. No resolution for the removal of the Vice President shall be moved unless at least fourteen days’ notice of the intention to move the resolution has been given.

উপরাষ্ট্রপতি নির্বাচনের জন্য ভারতীয় পদ্ধতি কি?

  5. যখন কোন রাজ্যের প্রতিনিধি পরিষদ বা হাউস অফ লেজিসলেচারের একজন সদস্য উপরাষ্ট্রপতি নির্বাচিত হন, তখন ধরে নেওয়া হয় যে তারা অফিস গ্রহণের দিন নিম্নকক্ষে তাদের অবস্থান ছেড়ে দিয়েছেন ।
  6. উপরাষ্ট্রপতির মেয়াদ শেষ হওয়ার কারণে শূন্যপদ পূরণের জন্য একটি ভোট অনুষ্ঠিত হয়।
  7. যদি মৃত্যু, পদত্যাগ, অপসারণ, বা অন্যান্য পরিস্থিতির কারণে একটি শূন্যপদ ঘটে, তাহলে পদটি পূরণ করার জন্য যত তাড়াতাড়ি সম্ভব একটি নির্বাচন অনুষ্ঠিত হয়।
  8. এইভাবে যে ব্যক্তিকে নির্বাচিত করা হয়, তিনি যেদিন দায়িত্ব গ্রহণ করেন সেদিন থেকে শুরু করে পাঁচ বছরের সম্পূর্ণ মেয়াদের জন্য যোগ্য।


যোগ্যতার মানদণ্ড:-

  1. তাকে অবশ্যই একজন ভারতীয় নাগরিক হতে হবে।
  2. সর্বনিম্ন বয়স সীমা 35 বছর।
  3. রাজ্যসভার সদস্য হওয়ার যোগ্য হতে হবে।
  4. কোন লাভজনক পদে অধিষ্ঠিত না থাকা।


সুবিধা:-

  1. রাজ্যসভার পদাধিকারবলে চেয়ারম্যান হিসাবে, উপরাষ্ট্রপতি বর্তমানে বেতন পান Rs. প্রতি মাসে 400,000।
  2. উপরাষ্ট্রপতি দৈনিক ভাতা, একটি বিনামূল্যে সজ্জিত বাড়ি, সেইসাথে চিকিৎসা, ভ্রমণ এবং অন্যান্য সুযোগ-সুবিধা পাওয়ার অধিকারী।
  3. সংবিধান অনুসারে, রাষ্ট্রপতির কার্য সম্পাদন করার সময় উপরাষ্ট্রপতি রাষ্ট্রপতির মতো একই ক্ষতিপূরণ এবং সুবিধা পাওয়ার অনুমতি পান।
  4. উপরাষ্ট্রপতি পেনশন তাদের বেতনের 50% এর সমান।


শূন্যপদ:-

  1. তার পাঁচ বছরের মেয়াদ শেষ হওয়ার সাথে সাথে।
  2. তার পদত্যাগে।
  3. যখন তাকে নির্মূল করা হয়।
  4. তার মৃত্যুর পর।
  5. তার নির্বাচন অবৈধ ঘোষণা করা হলে।


উপরাষ্ট্রপতির ক্ষমতা:-

  1. তিনি রাজ্যসভার পদাধিকারবলে চেয়ারম্যান হিসেবে কাজ করেন। এই ভূমিকায় তার কর্তৃত্ব এবং দায়িত্ব লোকসভার স্পিকারের সাথে তুলনীয়।
  2. পদত্যাগ, অপসারণ, মৃত্যু বা অন্য কোনো কারণে রাষ্ট্রপতির পদ শূন্য হলে তিনি শূন্যপদ পূরণ করেন। নতুন রাষ্ট্রপতি নির্বাচিত না হওয়া পর্যন্ত তিনি সর্বোচ্চ ছয় মাসের জন্য রাষ্ট্রপতি হিসাবে দায়িত্ব পালন করতে পারেন।
  3. ইলেক্টোরাল কলেজ অপর্যাপ্ত হওয়ার কারণে উপরাষ্ট্রপতি নির্বাচনে প্রতিদ্বন্দ্বিতা করা সম্ভব নয়।
  4. যে তারিখে সুপ্রিম কোর্ট তার ঘোষণা জারি করে যে তারিখের আগে একজন ব্যক্তির দ্বারা সম্পাদিত ক্রিয়াকলাপ যে উপরাষ্ট্রপতি হিসাবে একজন ব্যক্তির নির্বাচন বাতিল করা হয় না।


অভিশংসন:-

  1. উপরাষ্ট্রপতির পদের শর্তাবলী এবং সংসদ কর্তৃক তাকে বা তাকে পদ থেকে অপসারণের প্রক্রিয়া সংবিধানের 67 অনুচ্ছেদে অন্তর্ভুক্ত রয়েছে৷
  2. সেই সময়ে কাউন্সিলের সমস্ত সদস্যদের সংখ্যাগরিষ্ঠ দ্বারা গৃহীত রাজ্য পরিষদের একটি সিদ্ধান্ত একজন উপরাষ্ট্রপতিকে রাজ্যসভা থেকে অপসারণ করতে পারে।
  3. উপরাষ্ট্রপতিকে অভিশংসন করার জন্য লোকসভাকে এই প্রস্তাবটি অনুমোদন করতে হবে।
  4. একজন উপরাষ্ট্রপতি তার মেয়াদ শেষ হওয়া সত্ত্বেও তার স্থলাভিষিক্ত পদে প্রবেশ না করা পর্যন্ত তার পদে বহাল থাকবেন।
  5. উপরাষ্ট্রপতির অপসারণের জন্য কোন রেজল্যুশন স্থানান্তর করা হবে না যদি না রেজোলিউশন সরানোর অভিপ্রায়ের কমপক্ষে চৌদ্দ দিনের নোটিশ দেওয়া হয়।
